  • भारतीय प्रताधिकार कायदा भारतात प्रथम प्रसिद्ध निर्मितीस लागू होतो, भारता बाहेर प्रथम प्रसिद्ध झालेल्या कृती सुद्धा इतर बौद्धिक संपदा आणि एकस्व विषयक कायद्यांच्या अधीन पुर्नउपयोगापासून भारतात संरक्षित असू शकतात.
  • भारतीय प्रताधिकार कायदा ,१९५७(Chapter V कलम २५) अनुसार, अनामिक निर्मिती, छायाचित्रे, चलचित्र व तत्सम कला, ध्वनिमुद्रणे, शासकीय निर्मिती आणि खाजगी उद्योग-आस्थापना किंवा आंतरराष्ट्रीय संस्थांनी निर्माण केलेली कृती प्रथमप्रसिद्धीच्या तारखेपासून पुढे साठ वर्षांनंतर सार्वजनिक संपत्ती ठरतात, ही मोजणी ६०व्या वर्षानंतरच्या येणार्‍या नवीन calendar वर्षाच्या आरंभापर्यंत केली जाते.
