[ modifier ] Textes juridiques [Edit] Legal Texts Elle est citée à l'article 19 de la Déclaration universelle des droits de l'homme comme suit : It is mentioned in Article 19 of the Universal Declaration of Human Rights as follows:

» "Everyone has the right to freedom of opinion and expression, which implies the right not to hold opinions without interference and to seek, receive and impart regardless of frontiers, information and ideas through any expression whatsoever.

» "The free communication of thoughts and opinions is one of the most precious rights of man: every citizen may therefore speak, write and print freely, except to respond to the abuse of this freedom in cases determined by law. The Article 10 of the European Convention on Human Rights (which applies to all member states of the Council of Europe, much wider than the European Union) provides:

« 1 Toute personne a droit à la liberté d'expression. "1 Everyone has the right to freedom of expression. This right includes freedom to hold opinions and freedom to receive and impart information and ideas without having interference by public authority and regardless of frontiers. » This article shall not prevent States from requiring the licensing of broadcasting, television or cinema to a licensing system. » "2 The exercise of these freedoms carries with it duties and responsibilities may be subject to such formalities, conditions, restrictions or penalties provided by law and are necessary in a democratic society in the national security, the territorial integrity or public safety, the prevention of disorder and crime prevention, protection of health or morals, protection of the reputation or rights of others, for preventing disclosure confidential information or for maintaining the authority and impartiality of the judiciary. France) : Case law (European Court of Human Rights, January 21, 1999, No. 29183/95, and Fressoz Roire v. France):

» "Freedom of expression applies not only to" information "or" ideas "are favorably received or regarded as inoffensive or indifferent, but also those that offend, shock or disturb; thus the demands of that pluralism, tolerance and the open-mindedness without which there is no "democratic society". If the Universal Declaration of Human Rights of 1948 does not specify further conditions or restrictions on that freedom of expression, however, a number of courts, under the aegis of UN and acceding countries, however, impede this freedom by prohibiting the remarks inciting racial hatred, religious and national or under appeal in murder offenses are prohibited by law.

It goes hand in hand with freedom of information and more specifically the freedom of the press, which is freedom for a newspaper owner to say or to conceal what he pleases in his journal, subject to respond before the courts in cases of libel or slander. Slander and libel are there too, the restrictions imposed on the concept of freedom of expression for any public speech, as incitement to hatred and murder.

The International Covenant on Civil and Political Rights, adopted by the General Assembly of the UN states that freedom of expression includes "freedom to seek, receive and impart information and ideas through any media regardless of frontiers "(Article 4)..

Furthermore, the European Court of Human Rights states, in its decision in "Health Practice", that according to Article 10 of the Convention for the Protection of Human Rights and Fundamental Freedoms, failure renew a certificate by the Joint Committee for publications and news agencies (CPPAP) "amounted to interference by a public authority in the applicant's right to freedom of expression".

Importance Importance

Freedom of expression is often the first liberties eliminated regimes totalitarian. Since the late twentieth century, the emergence of modes of mass communication like the Internet and the difficulty of state and law to adapt to such technological developments have once again brought the issues:

d'une part au « contrôle » de la liberté d'expression. a part in "control" of freedom of expression. d'autre part à d'éventuelles mainmises sur celle-ci (cas de la Chine ). secondly to potential takeovers on it (the case of China). Freedom of expression has some limitations that must be expressly established by law and which are deemed necessary to respect the rights and reputations of others.

La liberté d'expression peut subir des restrictions : Freedom of expression may be subject to restrictions:

222-17 CP). Examples of legal restrictions on freedom of expression (France): The threat to commit a crime or a crime against persons whose attempt is a punishable offense (art. 222-17 PC). Incitement to commit a felony or a misdemeanor (art. 23 of the Act of July 29, 1881 on the freedom of the press). 223-14 CP). Propaganda or advertising of products, objects or methods advocated as means to commit suicide is punishable by three years imprisonment and a 45,000 euro fine (art. 223-14 PC). L'atteinte au secret professionnel (art.226-13 CP). The breach of secrecy (s.226-13 CP). Defamation and insult (Article 29 of the Act of July 29, 1881 on the freedom of the press).

In Switzerland, Article 261 bis of the Penal Code prohibits racial discrimination and prohibits the denial of genocide or other crimes against humanity [1].

When people in power or institutions officially involved or not to limit the expression, outside the limit case, we talk about censorship. The sex and violence are among the topics most often covered by censorship. Several states also have laws against blasphemy, considered by many secular activists as an attack on freedom of expression.

Article 11 of the Declaration of Human Rights and Citizen of 1789 provides a limit that each can reveal his thoughts to others including the idea that free expression, subject only to abuse that it would be.

The most glaring example is Article 14 of the Act of July 16, 1949 on "publications presenting a danger to youth, which may be by order of the Minister of Interior, restrictions their distribution and marketing when they present "a danger to young people because of their licentious or pornographic character or place given to crime, violence, discrimination or racial hatred, incitement to l 'use, possession or trafficking of narcotics. "

This scheme called preventive administrative ban does not occur only through the press but is also applicable to the cinema (prior authorization of the movies at the national level) or for Audiovisual Communication (with the laws of the 30 in September 1986 and January 17, 1989 to help establish new regulatory bodies for broadcasting).

The Act of July 29, 1881 on the freedom of the press also limits freedom of expression by establishing a repressive regime by providing for criminal indictments for libel and insult. Article 29 of the Act defines defamation as "Any allegation or imputation of an act that violates the honor or esteem of the person or body to which the act is charged" and abuse as as "any offensive expression, term of contempt or invective which does not contain any imputation of fact."

Freedom of expression also found a severe limitation on the respect for privacy (Article 226-1 of the Penal Code) and the right image. C. Petit). The case of Greater secret or doctor of former President François Mitterrand had barred the dissemination of his book for breach of confidentiality is a good illustration (Paris May 23, 1997 and Civ. 1st December 14 1999 JCPG 2000, II, 10241, concl. C. Petit).

"Freedom of expression is probably not the first freedoms (freedom of movement is the first freedom, freedom which determines priority and comes before all others), but it is certainly the first freedom Moderns ... Freedom of expression is Western freedom par excellence "(Freedom of expression in the United States and Europe under the direction of Elisabeth Zoller, Dalloz, 2008).

Loi californienne relative au droit sur l'image California law on the right image

In the United States, where a new anti-paparazzi law came into effect in California since 1 January 2010 was conducted by actress Jennifer Aniston and supported by many stars.

The role of California governor, Arnold Schwarzenegger, was crucial in the enactment of this Act. The former actor has himself been a victim of the paparazzi on several occasions including in 1998, when photographers had surrounded his car as he and his wife came to pick up their son to school.

The goal that the law is to protect celebrities and their families when they participate in family or personal activities. The law even includes an amendment that allows celebrities who feel aggrieved to sue the media buying and broadcast pictures taken illegally, which did not exist until now. Ces amendes iront de 5 000 à 50 000 dollars. The fines will range from 5 000 to 50 000 dollars.

The stars wish to avoid being harassed in their private lives and sometimes accidents. So, Nicole Richie has been a victim, a few weeks ago, an accident caused by a photographer who pursued her in the street.

Zusammenhang mit der Staatsform [ Bearbeiten ] [Edit] related to the state

Freedom of expression is a human right and is in a constitution as a guarantee against state violence directed fundamental right to prevent, will that affect the public opinion and the resulting confrontation with government and law, or even banned. Closely related to freedom of expression guarantees the freedom of information to access important information without having a critical opinion would not be possible, the prohibition of censorship prevents the expression and control of information by Government agencies. In contrast to a dictatorship of state power in a democracy, the means of preventive control of information are expressly forbidden by censorship.

Geschichte [ Bearbeiten ] [Edit] History

Freedom of expression was already 1789 in Article 11 of the Declaration of human and civil rights in France as one of the principal rights of the people (frz: un le plus précieux des droits de l'homme called). Today she is considered one of the most important benchmarks for the state of a democratic constitutional state.

Grenzen [ Bearbeiten ] [Edit] borders

Restrictions on freedom of expression allowed in most democracies do not suppress dissent, but only for national defense or to protect other important interests such as the minors are used. Repression, therefore, sanctions after the speech, is usually only for the protection of higher-and allowed an equal of other goods, but only on the basis of a sufficient limiting particularizing legally adopted law.

Allgemein verbreitete Einschränkungen der Meinungsäußerungsfreiheit sind (nicht abschließend): Widespread restrictions on freedom of expression are (not exhaustive):

der Schutz der persönlichen Ehre gegen Beleidigung oder Verleumdung , the protection of personal honor against insult or slander, die Weitergabe als geheim klassifizierter Informationen, the disclosure of classified information as secret, die übermäßige Kritik an eigenen oder ausländischen höchsten Staatsvertretern wie Staatsoberhaupt, Gerichten oder manchmal selbst einfachen Beamten, excessive criticism of their own or foreign highest state representatives such as head of state, or sometimes even simple justice officials, die Grenzen der Sittlichkeit und des Jugendschutzes , the boundaries of morality and of minors, die Grenze der öffentlichen Sicherheit (in den USA rechtshistorisch häufig angeführtes Verbot des missbräuchlichen Ausrufes „Feuer“ in einem Theater), besonders relevant in Zeiten des zunehmenden Terrorismus , the boundary of public security (in the U.S. legal history frequently cited the prohibition of abusive exclamation "fire" in a theater), particularly relevant in times of increased terrorism, der unlautere Wettbewerb durch Herabsetzung („Madigmachen“) der Ware oder Dienstleistung eines Konkurrenten. of unfair competition by lowering ( "Madigmachen") of the product or service from a competitor. In addition, it can ever give to constitutional tradition of significant differences in the reluctance of the state of repression: In contrast to the far right conservative United States, most European countries go much further. That is how the racial discrimination in contrast to the U.S. in Europe, usually punishable by private individuals (see sedition).

Internationale Regelungen [ Bearbeiten ] [Edit] International rules

Auf der Ebene der Vereinten Nationen ist die Meinungsfreiheit in Art. 19 der Allgemeinen Erklärung der Menschenrechte gewährleistet: At the level of the United Nations, freedom of expression in Article 19 of the Universal Declaration of Human Rights is guaranteed:

Everyone has received the right to freedom of expression, this right includes freedom to hold opinions without interference and to seek information and ideas through any media and regardless of frontiers, and to disseminate it. For the Member States of the Council of Europe Art creates 10 of the European Convention on Human Rights is a minimum standard for freedom of expression.

Within the European Union's freedom of expression and freedom of information in Article 11 has not yet set in force the Charter of Fundamental Rights.

Rechtslage in Deutschland [ Bearbeiten ] [Edit] Rights in Germany

In Deutschland wird die Meinungsfreiheit durch Art. 5 Abs. 1, S. 1, 1. Hs. In Germany there is freedom of expression by Article 5, Section 1, p. 1, 1 ms des Grundgesetzes (GG) gewährleistet. of the Basic Law (GG) guaranteed.

(1) Everyone has the right to his opinion by speech, writing and pictures freely to express and disseminate (...) A censure does not occur. The importance of this fundamental right has been concretized underscored by the Federal Constitutional Court in its case and. Thus in the Lüth-case from 1958: "The fundamental right to freedom of expression as the most immediate expression of the human personality in the company of one of the principal human rights in general. For a liberal-democratic order is simply constitutive.

That in the concept of "opinion" for the protection can not depend on whether it is a right or wrong, emotionally or rationally grounded value judgments, the Federal Constitutional Court clarified in 1972 in a verdict on the freedom of prisoners (BVerfGE 33, 1 (15) - prisoners): "In a pluralistic and structured on the concept of a liberal democracy-based political structure, any opinion different from the prevailing ideas about, for protection."

Although the German Constitution speaks only of the freedom of expression, but that does not mean that factual claims are excluded from fundamental rights. You are protected if they are a prerequisite for a definite opinion. Opinions expressed and factual claims can be in practice indistinguishable. Since false assertions of fact generally are not covered by the protection of freedom of expression is necessary in this case, a definition. With this definition occur in practice, major problems. This distinction in the base case is simple: an assertion of fact exists if the claim the evidence is available (eg, "The Party A is most members of the Democratic Party" is either true or false. A court can on these issues proved collect). An opinion however, defies the evidence and is instead dominated by values and opinion (eg the statement "The tax concept of the Party B for the 2005 Bundestag is unjust," neither right nor wrong, but rather constitutes a rating).

Freedom of expression also protects satire, comedy and cartoons, there is also, according to Article 5 GG is not censorship.

Art. 5 Abs. 2 regelt die Grenzen (Schranken) der Meinungsfreiheit: Article 5, paragraph 2 sets out the boundaries (barriers) of freedom of expression:

(2) These rights are limited by the provisions of general law, the legal provisions to protect young people and the right to personal honor. As with most other fundamental rights is also expressly provides for the possibility to restrict the fundamental right by law and so on. Is within the three referred to in Article 5 of the Basic Law limits usually only a throwback to the "general law" is needed, since the remaining barriers to the legal point of the Federal Constitutional Court have no outstanding features.

Unlike most other fundamental rights, the restriction of freedom of expression but also requires more than "general" law places greater demands on the legislature as the only "law". The Federal Constitutional Court therefore had to clarify what was meant by the term "general law" and described such a law so that it does not have a definite opinion as such in the eye, but must serve the one superior to the protection of legal protection and, secondly, random thoughts should take at most - not specifically and individually, but only indirectly. This leaves the case, however, still open, when a law can be truly as a general law, or whether it already has a "special" is.

As part of the so-called "reciprocal teaching" the Federal Constitutional Court, the problem of the general laws further complicated by the so-called Lüth ruling stipulates that: "The general law must state in their restrictive effects on the fundamental turn in the light of the importance of this fundamental right to be seen and interpreted that the particular value content of that right, which remains in the lead of liberal democracy to a basic presumption of freedom of speech in all areas, but especially in public life, must maintain at all costs. "(BVerfGE 7, 198 (207f. ) - Lüth) What is meant is that laws which restrict freedom of expression should be measured in turn on the importance of freedom of expression. The Constitutional Court has held that in the jurisprudential literature, among other things, result in interaction with this doctrine a circular argument, and to indirectly promote the evaluation of opinions on what exactly was not the meaning of Article 5 GG, but what would be preventing the freedom of speech precisely.

On the question of the prohibition of insult that is extensively clarified. Although the injury event is very broad (he used the term without) explain it, it is clear from his direction, that it does not prohibit a definite opinion. For the law assesses statements in this case solely on whether they, the general personality right, or threaten the honor of the addressee. On the content and message of a concrete expression occurs in the work.

That right there is traditionally a very broad interpretation, and partly also protects statements that in other countries as sedition, attacks on the constitution and incitement would apply to crimes.
