2005 (The Protection of Women from Domestic Violence Act, 2005) हा भारतीय दंड संहिता (Indian Penal Code) च्या तरतुदींपेक्षा (provisions) वेगळा आहे, कारण तो घरगुती हिंसाचाराची (domestic violence) अधिक व्यापक व्याख्या प्रदान करतो, ज्यात तो काय समाविष्ट करतो आणि कोणाला संरक्षण देतो हे स्पष्ट केले आहे.[२]
या अधिनियमानुसार (Act), 'पीडित व्यक्ती' (aggrieved person) ची व्याख्या "any woman who is, or has been, in a domestic relationship with the respondent and who alleges to have been subjected to domestic violence by the respondent" अशी केली आहे.[३] हा कायदा केवळ पती-पत्नीच्या नात्यातील हिंसाचारापासून महिलांचे संरक्षण करत नाही, तर ज्या महिला समान घरात अशा लोकांसोबत राहतात ज्यांच्याशी त्यांचे कौटुंबिक संबंध (domestic relationship) आहेत, त्यांनाही संरक्षण देतो.
अधिनियमाच्या कलम 3 द्वारे घरगुती हिंसाचाराची व्याख्या अशी केली आहे:[६] "any act, omission or commission or conduct of the respondent shall constitute domestic violence in case it:
- harms or injures or endangers the health, safety, life, limb or well-being, whether mental or physical, of the aggrieved person or tends to do so and includes causing physical abuse, sexual abuse, verbal and emotional abuse and economic abuse; or
- harasses, harms, injures or endangers the aggrieved person to coerce her or any other person related to her to meet any unlawful demand for any dowry or other property or valuable security; or
- has the effect of threatening the aggrieved person or any person related to her by any conduct mentioned in clause (a) or clause (b); or
- otherwise injures or causes harm, whether physical or mental, to the aggrieved person."[६]
Read more[permanent dead link]
(Protection of Women Against Domestic Violence Act) समाविष्ट आहे, अंमलबजावणीमध्ये अनेक त्रुटी (gaps) आहेत.[९] कायद्याविषयीच्या जागृतीचा अभाव (lack of awareness), आणि त्यामुळे सेवांची उपलब्धता व त्याबद्दलची माहिती, दिलासा/निराकरणाचे प्रकार (types of relief), तसेच कायदेशीर हक्कांबद्दलची माहिती नसणे हे कायद्याच्या योग्य अंमलबजावणीला (proper implementation) प्रतिबंध करते.[१०] या अंमलबजावणीतील काही समस्या विशिष्ट जिल्ह्यांमध्ये, जसे की ओडिशामध्ये दिसून येतात, जिथे नवीन संरक्षण अधिकारी (Protection Officers) नियुक्त करण्याऐवजी विद्यमान अधिकाऱ्यांवर (existing officers) या नवीन नियमांची जबाबदारी (responsibilities) टाकण्यात आली आहे.
(Committee on Reforms of Criminal Justice System) महिलांवरील गुन्हेगारी (offenses against women) यावर एक अहवाल लिहिला, ज्यात समितीने 'पत्नी' (wife) या शब्दाची व्याख्या "during the subsistence of the first marriage" अशा पुरुषासोबत दीर्घकाळ पत्नी म्हणून राहिलेल्या महिलांचा समावेश करण्यासाठी विस्तृत करण्याची मागणी केली.[१३] या स्पष्टीकरणानुसार (specification), 'पत्नी' च्या या विस्तृत व्याख्येचा संबंध विवाहित पुरुषासोबतच्या महिलांच्या संबंधांशी आहे, अविवाहित संबंधांशी (non-marital relationships) नाही.
(Chanmuniya vs Virendra Kumar Singh Kushwaha and Another)
तत्कालीन भारतीय महिला आणि बाल विकास मंत्री रेणुका चौधरी यांनी हिंदुस्तान टाइम्स मधील एका लेखात सहमती दर्शवली की, "an equal gender law would be ideal. But there is simply too much physical evidence to prove that it is mainly the woman who suffers at the hands of man".[१८]
भारताच्या तत्कालीन राष्ट्रपती प्रतिभा देवीसिंह पाटील यांच्या मते, "Another disquieting trend has been that women themselves have not been innocent of abusing women. Some surveys have concluded that 90 percent of dowry complaints are false and were registered primarily to settle scores. It is unfortunate if laws meant to protect women get abused as instruments of oppression. The bottom-line therefore, is the fair invocation of legal provisions and their objective and honest implementation."[२१]
